Dumpsters.com Terms and Conditions
These dumpster rental terms and conditions create a contract between you and Dumpsters.com. By using our services you signify that you have read and understand the terms and conditions set forth below as they apply to both commercial and residential dumpster rentals.
This transaction is limited to the dumpster rental terms and conditions contained herein and set forth to any related rental document, including, but not limited to, any quotation, proposal, acknowledgement, cancellation or invoice. Dumpsters.com terms and conditions stated herein shall apply to and govern all rental documents. These terms and conditions, along with the rental documents, establish an agreement between Dumpsters.com and customer. In the event of any conflict between Dumpsters.com and customer, the dumpster rental terms shall govern and control.
Dumpsters.com intakes and processes all dumpster rental orders via telephone at 1-844-444-3867 or online through our website located at www.dumpsters.com (the “website”). Customer acknowledges and agrees that upon placement of an order for a dumpster and Dumpsters.com’s acceptance of the order, a binding and enforceable rental agreement shall exist between both parties. All rental orders accepted by Dumpsters.com are accepted with the understanding that each order is subject to Dumpsters.com’s ability to obtain and furnish the dumpster to customer.
Delivery and Pickup
Detailed instructions for delivery and pickup of a dumpster is discussed during the initial rental process. Dumpsters.com strives for timely delivery and pickup, but due to circumstances beyond our control, including inclement weather, hazardous roads, traffic delays, motor vehicle accidents and obstructing items (vehicles, low-hanging powerlines and tree branches) blocking entrance to desired location, we cannot and do not guarantee delivery and pickup times. As a result, Dumpsters.com will not be liable to customer under any circumstances for costs, losses or damages incurred by customer in relation to such circumstances. Upon delivery of the dumpster, customer shall not move or transport the dumpster from the designated site without prior notice and consent from Dumpsters.com. In the event we cannot pick up the dumpster due to the storage of prohibited items, a dumpster that has exceeded its weight limit or any other reason beyond our control, a trip fee of $150 will be assessed to the initial invoice. Customer acknowledges and agrees that Dumpsters.com is authorized and entitled to impose a trip fee if necessary.
Customer can rent as many dumpsters as needed and shall be issued a separate invoice for each. Payment is made over the phone at time of order by way of credit card. Dumpsters.com accepts the following forms of credit: American Express, Discover, MasterCard and Visa. Customer acknowledges and thereby authorizes Dumpsters.com to retain credit card information. Customer also acknowledges and agrees that such credit card authorization shall remain valid and in effect during the applicable rental period.
Cancellation and Cancellation Fees
Once an order has been placed and accepted by Dumpsters.com, customer may not cancel without the consent of Dumpsters.com. In the event an order gets cancelled, Dumpsters.com shall be entitled to enforce a cancellation fee which may be charged to customer’s credit card. A cancellation fee of $25 will be assessed if the cancellation occurs prior to 3 p.m. the business day before customer’s scheduled delivery. If cancellation occurs thereafter, a cancellation fee of $150 will be accessed.
Weight Restrictions and Overage Fees
Customer is responsible to adhere to the weight limits of the dumpster. Failure to stay within the weight restrictions, either due to the materials inhibiting the dumpster or rain, snow or ice that has accumulated, customer acknowledges and agrees that Dumpsters.com will enforce an overage fee of $125 per ton.
Dumpsters.com can deliver a dumpster to almost any residential or commercial site. Customer acknowledges that certain locations, including a municipal street, may require a permit, license or certification in order to place the dumpster at a desired location. Customer is responsible for obtaining and maintaining all necessary and required documentation if the situation calls for it.
Dumpsters.com accepts many items, but there are some that require separate disposal through a municipal or specialty service. Prohibited items include any flammable, toxic or hazardous materials. In addition, food waste, infectious waste, fuels, adhesives, batteries, tires and railroad ties are also prohibited. A full list of prohibited items is available on the Dumpsters.com site. Customer is responsible for complying with all applicable laws pertaining to prohibited items and shall be liable for any expenses relating to damages to dumpster and landfill penalties.
Customer shall indemnify, hold harmless and defend Dumpsters.com, its respective officers, directors, agents, affiliates, employees, subsidiaries, successors from any and all claims, counterclaims, damages and expenses asserted or alleged by a third party arising from or related to an overloaded dumpster, a customer’s failure to obtain or maintain a permit, a customer’s use or storage of prohibited items, loss or theft of a dumpster, damage to a dumpster during the rental period, personal injury or property damage relating to customer’s use or possession of a dumpster, physical damage to streets, roadways or driveways caused by a dumpster and a customer’s breach of these dumpster rental terms and conditions or any of the aforementioned rental documents.
Waiver and Limitation of Liability
Customer herby waives any and all claims and losses against Dumpsters.com relating to or arising from customer’s dumpster rental or Dumpsters.com’s performance under the rental documents. Any claims arising from damage to customer’s property, including driveway, walkway or lawn shall be waived except in the event of the gross negligence or intentional misconduct of Dumpsters.com.
Dumpsters are delivered “as-is” and Dumpsters.com issues no warranties to customer, including the warranty of merchantability or that the dumpster will meet your requirements.
Any and all disputes arising from the dumpster rental transaction between Dumpsters.com and customer, including these dumpster rental terms and conditions, shall be interpreted in accordance with and governed by state laws. This includes all matters stemming from construction, validity and performance.
Upon Dumpsters.com’s acceptance of the customer’s dumpster rental, the terms and conditions set shall establish an agreement between Dumpsters.com and customer. No statement, correspondence or other terms shall modify or affect the dumpster rental terms. Unless otherwise approved by Dumpsters.com, no change in these terms and conditions will be valid.
